Abstract

This paper aims to analyze the changes in the administrative judge's investigative powers in light of the progressive digital transformation of public administration. Starting from the centrality of the preliminary investigation as a place to rebalance information asymmetries between the parties, the paper examines the impact of the digitalization of evidence in the trial, with regard, on the one hand, to the introduction and evaluation of data as evidence and, on the other, to the possibility of using artificial intelligence in the preliminary investigation phase
