Abstract

This brief study aims to clarify whether the protection of subjective legal situations arising from administrative activities changes when the Public Administration (hereinafter PA) uses artificial intelligence (hereinafter AI) tools.

We will begin with a brief description of the "traditional" protection configuration in question, examining separately the cases of the exercise of power and the provision of services. After briefly illustrating the reasons why computer algorithms are relevant to administrative law, we will attempt to clarify whether their use determines, or not, variations in the mechanism for attributing decisions or services.
