Abstract

To understand the motivations and effects of any phenomenon of social (as well as legal) significance, it is essential to first contextualize the topic historically, supported by an approach aimed at highlighting the ideological, ethical, political, economic, sociological, and, last but not least, religious constraints that have shaped it.

Given this premise, it is clear that the theme of "Territorial Assistance and Horizontal Subsidiarity" is composed of two distinct areas: one that could be defined as "humanitarian," responding to a prevailing logic of solidarity, guaranteed by the constitution; the other, social and healthcare, based mostly on organizational and efficiency-oriented logics.

The interaction of the two components will guide the path of this investigation with the aim of arriving at a treatment that allows us to grasp the true extent of the problems faced, the sometimes contradictory solutions devised by the legislator, the existence of obstacles, economic but not only, deriving from the absence of a more coherent and conscious policy of incentives for the implementation of the quality of the territorial healthcare offer
