Direttiva UE in materia di lavoro tramite piattaforme digitali: prime riflessioni in vista del recepimento in Italia


Abstract


The adoption of Directive (EU) 2024/2831 on platform work—approved on October 23, 2024, and officially entering into force on December 1 of the same year—has reignited the debate, both nationally and internationally, regarding the conditions of workers who perform their services through such platforms. This debate appears unlikely to end any time soon, given that Member States—including Italy—have until December 2, 2026, to implement the directive's content and adapt their domestic legislation to its provisions. The Ministry of Labor also subsequently intervened in the debate, clarifying—without intending to preempt the national legislator's decisions and pending the directive's transposition—the need to clarify the classification and protections applicable to the work performed by cycle couriers working on digital platforms. In this context, the Ministry has therefore deemed it appropriate to reiterate that, like any other form of work activity, that of cycle couriers can also fall within the scope of self-employment or employment, depending on the specific methods of carrying out the service
