Abstract

This study examines the evolving relationship between the public Administration and emerging technologies, particularly algorithms and Artificial Intelligence, against the backdrop of the personalistic principle enshrined in Article 2 of the Italian Constitution. The massive adoption of automated procedures raises concerns about the potential depersonalization and delegation of crucial decision-making and investigative power to algorithms. The core argument is that the personalistic principle should serve as the axiological foundation for administrative action, ensuring the public Administration remains functional to human development and the guarantee of inviolable rights
