La situazione fiscale dell’operatore economico

Abstract

This contribution analyzes a fundamental aspect relating to the participation requirements of the economic operator in the context of public procurement whose verification aims to ascertain the financial solidity and its reliability through the analysis of the requirements on fiscal regularity that it is called upon to possess to be able to contract with the Public Administration. The relevance of the causes of exclusion in relation to the lack or loss of the participation requirements is examined and, in these terms, the fiscal situation of the economic operator becomes a crucial element in the recognition of the suitability of the same for participation in tenders and in any case, more specifically general, to stipulate contracts with the public administration.
