Abstract
Administrative acts of order can be traced back to many types with differentiated characteristics and elements. The evolution of the Italian legal order, academia and case law developed theories to identify elements capable of classifying the different types of order administrative acts.
The purpose of this article is to analyze the origin and evolution of administrative acts of order and to examine their use in the military administration, where the hierarchical relationship between the physical subjects acting within it, the specifics of the public interest protected and likewise the need to guarantee effectiveness and efficiency in its pursuit, characterize the acts issued and its organization.
The analysis aims to investigate the possibility of use to administrative acts of order as a means of overcoming problems of administrative procedures, such as the so-called defensive bureaucracy, the possible perspectives and criticalities in organizational terms and in the performance of administrative functions, as well as the consequences on the economy.
