Diritto alla rinegoziazione dell’appalto pubblico e riparto di giurisdizione: problemi sostanziali e processuali


Abstract


The new Code of Public Contracts. D.lgs. No. 36 of 2023, has generalized the right to renegotiate a public contract that has become unbalanced, even in the absence of special renegotiation clauses. However, if the contracting station fails to fulfill its obligation to renegotiate, it is unclear whether the economic operator should sue it before the administrative court or the ordinary court. The complex regulatory network narrowed by Articles 9, 120(8) of Legislative Decree No. 36 of 2023 and 133(e) c.p.a. argues in the latter sense, since the private party suffering the unfavorable contingency has a subjective right to renegotiation and not a legitimate interest. However, in the case of renegotiation in the absence of the conditions provided by law, it is possible that excluded economic operators may claim a legitimate interest at the renewal of the public procurement
