Abstract

The issue of health risk management poses crucial application questions from a bioethical, legal and social point of view. This work aims to analyze the deflative function of litigation and the inseparable connection with the disciplinary status of medical health liability in the light of its normative evolution. The debate on this subject necessarily starts from the study of the complex legal framework in the field of health liability, which will be critically analysed with a view to identifying possible de iure condendosolution. The management of malpractice plays a crucial role in ensuring quality of care, maintaining trust in the health organisation, ensuring access to justice and promoting sustainability of the health system. In this context, the clinical risk management system assumes an extraordinary deflative value of litigation, a process of systemic nature that encompasses both the clinical and the more managerial components
