Abstract

Among the open issues in the great construction site of Legislative Decree 231/01, a prominent place is certainly represented by the slow, gradual and constant assimilation of the legal person to the natural person, also in the field of procedural instruments for defining criminal proceedings. As is known, in fact, art. 63 provides that, "the application of the sanction to the entity upon request is permitted if the judgment against the defendant is final or definable pursuant to art. 444 of the Code of Criminal Procedure, as well as in all cases in which the administrative offence is subject only to a pecuniary sanction".
