La partecipazione del proponente alla predecisione di impatto ambientale

Abstract

The d.l. n. 77/2021, converted by l. n. 108/2021, as part of a broader intervention aimed at "simplifying" and "accelerating" environmental procedures, excluded the application of art. 10- bis, of the l. n. 241 of 1990 to the environmental impact assessment. This contribution intends to assess whether the requests for acceleration in the implementation of public or private projects underlying the recent legislative interventions caused by the economic crisis caused by the Covid-19 emergency justify a de-quotation of the participatory guarantees of the proponent to the "predecision" of environmental impact
