Abstract

This legal paper addresses the issue of the proportionality of the demolition of the only house occupied by a mother with minor children for less than a year, according to the recent tuling of the European Court of Human Rights of 11 april 2023 (Case of Simonova v. Bulgaria) and the consequent need of the Italian judge for an adaptive interpretation that is not only formal but substantial and evolutionary as well, due to the "sociality" of the right to housing, counted among the fundamental rights of the person, with which the democratic State complies.
