Abstract

The identifying criterion of the concession relationship understood as the traditional trilateral relationship between the granting administration, the concessionaire and the recipients of the public service, although it still has an independent value, has certainly changed with the advent of European Union law, which by not distinguishing the different positions subjective legal rights of the citizen as known to us, tends to generalize the traditional categories of authorizations and concessions, reducing them all to forms of ex ante control that the authority exercises before the start of a given activity in order to guarantee the correct application of the market competition rules.
