Abstract

This paper aims to analyze the basis and ratio of the consultative function of the Council of State.
According to the author's opinion, the contiguity of the administrative judge to the public interest is the reason why the constitution has assigned consultative and jurisdictional functions to the Council of State.

Consultative function and judicial function represent two complementary and synergistic activities carried out at the service of the legal system.
