La protezione della salute personale (articolo 32 Cost.), in qualità di coefficiente politico (con risonanza giuridica) della sistematica dei valori costituzionali è funzionalmente diretta (anche) a garantire il ruolo spettante ad ogni componente del “popolo sovrano" di poter concorrere alla formazione della volontà generale.

Abstract

There is a need to prevent any doubts relating to the exact delineation of the investigation undertaken as, as specified in the title, it aims to investigate the potential in perspective of the provision on the right to health of the individual also as an interest of the collectivity (article 32, 1st Const.), consequently it does not intend to retrace the "ancient scales" of the purely literal illustration that it surpassed after the first readings then proposed (some more direct to clarify the content to be attributed also in terms of scientific health knowledge) and consequently does not intend to take the cue from the disputes in the square, which for certain profiles seem to want to evolve in the statute of new political formations.
