L'attuale ambito di esercizio del diritto del cittadino di esprimere liberamente il proprio pensiero (art. 21 Cost.) può ancora considerarsi conforme alla Costituzione nel nuovo confuso clima politico che tende con molte incertezze a stabilizzarsi


Abstract


First of all, it is necessary to indicate the reason that prompted attention to reconsider the action of the presence in the Constitution of the aforementioned right to freely express one's thoughts in speech, writing and any other means of dissemination, because the related topic, after the 70/90 years in which it had been moderately examined and debated, it suffered a slow inattention, it remained as a "monad" neglected by the attention of both politicians (and this can be understood) and legal investigation, unless there is a new attention due to the latest events of gratuitous street violence.

It is true that in the years indicated above the question was raised more on the implementation of the provision contained in the XII transitional and final provision, which contains the prohibition of reorganization in any form of the dissolved fascist party (and this in itself is justified) but also and more broadly on the question relating to the claimed freedom relating to the means of public communication by private individuals who reacted against any form of limitation, such as the concession then envisaged.
