Abstract

A consistent academic tradition has tried its hand at the definition of the sports system, on its perimeter, on its relations with the state system: after many years the theme continues to be the subject of meditation and new perspectives, in the light of various phenomena ( the emergence of a European dimension of sport pursuant to art. 165 TFEU, the term "sports system" contained in art. 117 of the Constitution, the decisions of the Constitutional Court of 2011 and 2019 on the boundaries and limits of jurisdiction following the rulings of the sports judge, the recent organic provision of a reform of the sports system on the basis of Law 86/2019 laying down delegations to the Government and other provisions on the sports system, sports professions and simplification, however, hesitated in a partial review of a regulatory system now dating back, the even more recent legislative decree 5/2021 with which measures have been adopted urgent matters regarding the organization and functioning of the Italian National Olympic Committee following a crisis threatened by the IOC)
