Regulatory Sandbox italiano in una prospettiva europea, costituzionale ed amministrativa

Abstract

Without prejudice to the fact that in the world there are many examples of regulatory sandboxes in the most varied sectors, this contribution analyzes the government initiative ("Experimentation Italy") included in the c. d. "Simplifications decree", and the contextual action of "Italy 2025", ie the strategy for technological innovation and digitization of the country (A12 - Right to innovate).

Specifically, the decree-law of 16 July 2020, n. 76, converted, with amendments, by law 11 September 2020, n. 120, containing << Urgent measures for simplification and digital innovation >>, through art. 36 (<< Administrative simplification measures for innovation >>) facilitates the experimentation of projects not permitted by current legislation; in particular, it is possible to request authorization for the experimentation of initiatives relating to technological innovation as a temporary derogation from one or more impeding regulations of the State
