Il rapporto funzionale tra il diritto allo studio (e/o all'istruzione) e la contestuale previsione della "libertà di insegnamento" può ancora alimentare profili problematici se non si procede, ancora una volta, alla "ricomposizione" sistematica dei valori fondanti la Costituzione, la quale a sua volta può svelare la ratio giuridica della disciplina adottata dai Costituenti

Abstract

It is easy to understand how he writes the term just used, perfectly fitting for the long discourse that the theme referred to in the title suggests and requires, a long illustrative itinerary which, to whom has been suggested by having repeatedly returned to the interpretative methodology of individual provisions adopted, not without difficulty, by the Constituent Assembly. And it is equally understandable that difficulties are well explained if we consider that having not registered a classic "revolution" in which a "party" has achieved a clear "majority", if anything with the explanation of general violence, the Constitution has in any case intended the regime of "democratic republic" using the equally "democratic" methodology, which therefore was ultimately exercised while retaining part (if not all) of the instrumentation historically consolidated in the previous liberal parliamentary regime (the profile will be better discussed later)
