Abstract

The scope of the present essay is to analyze the evolution over the time and the relevant case law of the so called “soccorso istruttorio”, the legal instrument pursuant to which economic operators are allowed to integrate or correct the offers filed in tender procedures, in case of mistakes or other discrepancies in respect to the tender lex specialis. The essay examines the legal modifications that “soccorso istruttorio”has suffered and the uncertainties still affecting its application.
