Il divieto di bis in idem tra ordinamento nazionale ed europeo

Abstract

The ne bis in idem is a principle governed by supranational legal systems and envisaged by the Italian penal procedure code. Often the European Courts intervened to define a uniform application of the "European" ne bis in idem in the legal systems of the signatory States. Moreover, the Grand Chamber has decided on the existence of several proceedings deriving from the same fact through the judgment A. and B. c. Norway; furthermore, this decision has produced effects mostly for the Italian cases of the “double track” of verification of criminal offenses, in particular when an administrative/sanctioning procedure was also activated beyond the criminal trial.
