La piena tutela dell’interesse sostanziale del terzo davanti al Giudice amministrativo nell’attività edilizia soggetta a SCIA

Abstract

This short paper aims to reflect – again – about legal regulation of SCIA after the delivery of judgment n. 12/2019 by Administrative Court (TAR Emilia Romagna Parma), that refers to the Corte Costituzionale for the review of constitutionality of our actual legislation on protection of third party’s interest. According to the Administrative Court, legislation doesn’t provide a sufficient level of judicial protection to the third party, who is forbidden to propose action for annulment against SCIA because of its private nature.

In the meanwhile, the sentence n. 45/2019 by Corte Costituzionale rejects the question of constitutional review of the same rule referred several years ago by TAR Toscana Firenze (ordinanza n. 667/2017), offering furthers opportunity of thought.
