Le Problematiche degli organi inquirenti della giustizia sportiva: la necessità di un’Avvocatura Generale dello sport


Abstract


Since the entry into force of the justice reform, the system that has been created between the activities of the Federal Prosecutor's Office and the activities of the General Public Prosecutor, despite the presence of some cases of conflict, has nevertheless brought good results: in four years of post-reform sporting justice, 8396 judicial files were presented, of which 1975 were concluded through sanctions on request with or without blaming (cit. negotiation); In addition, the relationship between the General Public Prosecutor's Office and the Federal Prosecutor's Office is very complex due to the lack of clarity in terms of regulations and the evolution of sports regulations. Despite the excellent results obtained, an evolution is necessary to improve the relationship between the two Public Prosecutor's offices and to keep pace with the evolution of the sports system and the world in which it operates in order to guarantee the best possible protection for the subjects within the legal system.
