Abstract

The paper analyses the Italian legal framework about municipal pharmacies, starting from two judgements by the Italian Constitutional Court and by the Council of State.

The Italian Constitutional Court deals with the disposal of shares by municipalities in municipally owned corporations with public-private partnership to manage municipal pharmacies.

The Council of State refers to the European Court of Justice the Italian laws about the pre-emptive rights in selling municipal pharmacies.
